Full Breakdown
020(4) makes payment a precondition of use: no person may use any facility, shelter, land or other area for which the Parks and Recreation Committee has set a fee without paying it before the use begins. The Department's online registration system handles reservations for campgrounds at Big Eau Pleine, Dells of the Eau Claire and Marathon Parks, and the same fee-first rule extends to shelter rentals citywide. 040 regulates commercial and promotional activity inside parks. Subsection (a) bars selling or offering for sale any goods, wares or merchandise in a park unless the Department or City authorizes it and the seller holds the required licenses.
Subsection (b) bars distributing or posting bills or advertisements anywhere in a park without the Committee's written consent. 20, adopted March 11, 2025 under Ordinance No. 020(3). A group planning a gathering that involves selling items, handing out flyers, or using a reserved shelter should confirm both the facility fee and any sales or posting authorization with the Department before the event.
Violations & Fines
Chapter 9.20 sets no stand-alone forfeiture for unpaid facility fees or unauthorized sales and postings, so the citywide default in Section 1.01.110 applies: not less than $10.00 nor more than $200.00 for a first offense, and not less than $25.00 for a repeat conviction, with each day of continued violation a separate offense. The Department can also exclude a violator from further use of the facility.
