c.Parklet. Parklets, may be placed in a public right-of-way, subject to the following:1.Parklets must comply with the parklet requirements as approved by the traffic and parking board and which address the allowed locations, design requirements, safety, and maintenance responsibilities.2.Unless approved for private commercial use pursuant to this subsection, the parklet shall be available for use by the general public.3.The director shall review any parklets and approve it if the director finds that it complies with the parklet requirements and will create new public space or space for commercial uses that support an active streetscape.

The permit holder must carry city-required insurance for the life of the encroachment and must remove it on 10 days' written notice if the Director finds it interferes with public access. m. Sunday-Thursday in the NR Zone and Mount Vernon Avenue Urban Overlay, and must leave at least five feet of clear sidewalk for pedestrians.
Violations & Fines
A permit can be revoked whenever the holder fails to comply with any permit condition, and Sec. 5-2-29(a)(4) lets the Director order removal of an encroachment, including a parklet, on 10 days' written notice if it interferes with public access or the public welfare; if the holder can't be found or misses the deadline, the Director may remove it at the holder's expense and the city bears no liability for damage to the structure. Any encroachment placed without an approved permit, or one that doesn't fit the categories authorized by Sec. 5-2-29(b), may be permitted only by special ordinance of the city council.
