412(d)(5) governs equipment on outdoor commercial patios and draws a clear line: portable outdoor heaters may be permitted, immediately after the sentence banning barbeques, grills, stoves, and other outdoor cooking appliances in the same areas. Because the operational standards in subsection (d) apply to every outdoor commercial patio approved under this section, whether located on private property, a public sidewalk, or converted street parking, a restaurant or retailer that has obtained the ministerial patio permit can add portable heaters to extend seasonal outdoor seating into cooler months without a separate special-event permit.

412(e)(1) requires that portable heaters and any associated utility extensions comply with the California Fire and Building Codes, including Title 24, Chapter 11B. The patio operator must still keep the space in a clean, orderly condition, and the heaters sit within the same 750-square-foot aggregate patio area cap and four-foot sidewalk clearance requirement that governs the rest of the patio footprint. There is no separate seasonal-heater permit or date-limited authorization in the Fremont code; the heater allowance is a standing feature of the outdoor commercial patio permit itself, not a special one-time event approval.
