Lighting, heating and air circulation devices. All semi-permanent structures built for full-year Sidewalk Cafés must employ lighting, heating and air circulation devices. Such devices shall be placed within the confines of the semi-permeant structure of the Sidewalk Café and shall be placed and used in such a way that minimizes the impact/effect on adjacent businesses, buildings, and pedestrians. Any heating device shall be subject to fire code inspection and must be installed, maintained and used in accordance with all applicable New Jersey Fire Code regulations. At minimum, heating devices must not be positioned closer than five (5) feet (1524 mm) to any combustible decorations and combustible overhangs, awnings, sunshades or to any exits. Heating devices must not be utilized inside tents or canopies or membrane structures and the roofs of all Sidewalk Cafés must have an open area within five (5) feet of where the heating devices are located.
