Charlottesville, VA Special Events & Permits: Sidewalk Dining & Cafés (2026)

Article VI of Chapter 28 requires a permit before any person operates an outdoor café on a city sidewalk or the downtown pedestrian mall, issued by the zoning administrator under § 28-211(a). The city manager separately approves a map of eligible mall locations, updated annually with 30 days' notice to operators, and city council sets the schedule of rents, fees and charges that must be paid before a space is reserved.

Only the operator of a licensed restaurant may apply, under § 28-212(a), for a permit to run a café on the sidewalk contiguous to that restaurant. Restaurants abutting the mall on Main Street between East Seventh Street and Ridge-McIntire Road may apply for mall or side-street space in the same block; if none is available, they can still get sidewalk space next to their own restaurant provided at least 12 feet of clear sidewalk remains for pedestrian travel and any fire lane. No operator may be assigned all the space on a single mall block, and no single café may exceed 800 square feet, though operators already over that size as of March 1, 2011 may keep their existing footprint.

The zoning administrator grants a permit, valid for one permit term of up to a year, only after finding the restaurant operates lawfully in its zoning district, the café won't endanger public health, safety or welfare, and all rents and fees are paid; a café in a design-control district also goes through the board of architectural review. Conditions under § 28-214 bar on-site food preparation, require prompt clean-up after each customer and daily, limit musical entertainment to unamplified performances outside midnight-to-11 a.m. hours, and cap tents to twice a year for no more than 72 hours. A $1,000,000 public liability policy naming the city as additional insured is required under § 28-215.
