If located within 500 feet of a single-family detached dwelling or a SFR-5 zoning district, the outdoor seating area shall be closed between the hours of midnight and 7:00 a.m....g.The outdoor seating area of a eating or drinking establishment may be permitted on a public sidewalk abutting the front of the property containing such business, subject to the following conditions:i.Prior to commencing use of the license area, the business owner or operator shall enter into a revocable license agreement with the City pursuant to section 6.3.I.

Sound equipment, including speakers and amplifiers, cannot run louder than necessary for people inside the seating area to hear it, and cannot disturb the peace, quiet, or comfort of neighboring properties. Where alcohol is served, the perimeter of the seating area has to be defined consistent with Florida's alcoholic beverage regulations.
I, Encroachments into Right-of-Way. That agreement requires the operator to carry liability insurance, proof submitted annually with the local business tax renewal, to keep a clear ADA-compliant pedestrian path through the sidewalk, and to maintain at least five feet of clearance from any alley, crosswalk, fire hydrant, or similar access feature. Tables, chairs, and other furnishings cannot be chained or otherwise attached to trees, posts, signs, or other street furniture, and any enclosure of the license area by fence or barricade needs the City Manager's express sign-off.
Violations & Fines
If an operator violates these standards or the license agreement and does not fix the problem within a reasonable time after a City order, the City can remove or relocate the sidewalk seating furnishings at the operator's expense. The City Manager can also terminate the license agreement outright if the seating interferes with the normal use of the surrounding sidewalks or streets, ending the operator's right to use the public right-of-way for outdoor dining.
