the city may issue revocable permits to businesses who apply for a permit to operate an outside establishment as an extension of, or compatible with, the existing business on a portion of a city sidewalk. The outside activities, sidewalk cafes, are limited to activities carried on by the existing business. The permit may be issued under the following terms and conditions:
(1) Such permits shall be issued if the director of the Department of Economic Development, or their designee, determines the occupancy will not:
a. Unreasonably interfere with the use of the street and/or sidewalk area for vehicular or pedestrian travel, respectively.
b. Unreasonably interfere with the view of, access to or use of property adjacent to such street.
c. Violate regulations adopted by the director to interpret and implement the provisions of this section.
(2) Notice to the adjacent property owners or occupants shall be required before another person can be issued a permit to occupy any sidewalk area between the edge of the vehicle use area of the street and the property line.
(3) Prior to issuance of a sidewalk occupancy permit, a permit fee shall be paid of $15.00 for the period of the permit, not to exceed 120 days; which fee shall be tripled if any such occupancy occurred prior to the issuance of a permit.
