Fountain Valley, CA Special Events & Permits: Sidewalk Dining & Cafés (2026)

Section 21.10.070(b) bars anyone from owning, operating or engaging in permanent outdoor dining without a current, valid city-issued outdoor dining permit, and the permit covers private property. An applicant completes the city application form, pays a non-refundable application fee and holds a city business license. The director of planning and building approves or denies in writing after finding that the permit would not be detrimental to public convenience, health, interest, safety or welfare, that the use is consistent with the general plan and any specific plan, and that it complies with the section and the code. Conditions can cover hours of operation, nuisance controls for noise, odors, smoke, waste, loitering and circulation, beer and wine procedures, and an indemnity in favor of the city.

Some patios skip the administrative permit and need a CUP under Chapter 21.36: dining with entertainment within 200 feet of a residential zone and in line of sight of homes, exterior amplified sound within 200 feet of a residential zone, hours between 11 p.m. and 6 a.m., any dining within 50 feet of a residential property line, or any case the director expects to cause noise, odor or access problems or involving an operator with a prior enforcement history.

On private sidewalks, breezeways and plazas a restaurant can use the space beside its own business, but the dining area cannot be wider than its frontage. Dividers or fencing must be at least 3 feet high, exit paths must be 44 inches wide, areas with an occupancy above 50 need two exits, and awnings and umbrellas need 7 feet of vertical clearance. Outdoor music and amplified sound end at 10 p.m. Separately, § 21.10.050(a)(2)(G) permits dining within public sidewalks in the MU-1 and MU-2 zones if a path of travel at least five feet wide is maintained.

The permit lasts for the business license period, renews annually and runs with the land.
