The transportation department is authorized to issue permits for the operation of sidewalk cafés in accordance with the following standards and regulations. No person shall operate a sidewalk café without such a permit. The transportation department is authorized to revoke such permits for noncompliance with the standards and regulations.(b)Issuance of permit. No permit for the operation of a sidewalk café may be issued unless the application is complete and unless the following requirements are met:(1)The sidewalk café must be associated with an operating restaurant. The sidewalk café must be operated under the same name as the restaurant and may not be open or operated at any time when the restaurant is not open for business. Sidewalk cafés may operate at any time between the hours of 7:00 a.m. and 1:00 a.m.
