National City, CA Special Events & Permits: Sidewalk Dining & Cafés (2026)

Section 18.30.200 of the National City Land Use Code (Title 18) treats sidewalk cafes as a public-space benefit and sets the permit path. A sidewalk cafe requires a right-of-way permit under the city's right-of-way enhancement program. The planning division can approve it if the cafe conforms to every requirement of the section, and an encroachment permit must then be obtained from the City Council. In granting a minor use permit for a cafe, the planning division makes findings that the operation meets the section's limits and can attach conditions to protect public safety and welfare.

A cafe is allowed only in a zoning district that allows indoor restaurants, and it must sit on the public sidewalk immediately adjacent to and abutting the restaurant that operates it, extending no farther than that restaurant's own sidewalk frontage. Its operation must be incidental to and part of the indoor restaurant. Serving alcoholic beverages to cafe customers is prohibited.

On the sidewalk itself, the sidewalk must be wide enough to handle normal pedestrian traffic, and at least fifty percent of its width and not less than eight consecutive feet must stay clear and unimpeded at every point. Tables and chairs must be set back at least two feet from any curb or sidewalk or street barrier, including a bollard, and stay out of the eight feet surrounding any designated bus stop.

Furniture must be movable and of commercial quality, plastic tables and chairs are not permitted, umbrellas need a base of at least sixty pounds, and outdoor heaters, music and speakers are prohibited. The only signage allowed is the establishment's name on an awning or umbrella fringe. Only food and nonalcoholic beverages prepared or stocked at the adjoining restaurant can be served. Outdoor food preparation, busing and server stations, and presetting tables with utensils, glasses, napkins and condiments are prohibited. Trash cannot be stored in the dining area or on adjacent sidewalks.

Hours run from seven a.m. to ten p.m., the cafe must stay one hundred fifty feet from the property line of any parcel with a detached single-family residence, and all furniture is stored indoors at night. The city manager or a designee can suspend a cafe at any time for festivals, parades, marches, street or sidewalk repairs, demonstrations or emergencies.
