Newark, NJ Special Events & Permits: Sidewalk Dining & Cafés (2026)

City Code § 29:26-3 flatly prohibits operating a sidewalk cafe "without having first obtained a license from the City of Newark," issued through the Division of Tax Abatement and Special Taxes after a review by the Director of the Department of Engineering covering location, pedestrian and vehicular interference, design, and the applicant's business record, per § 29:26-4. The applicant must be the restaurant's own owner or registered agent, and all property taxes and water/sewer charges must be current before the application is even reviewed. Fees under § 29:26-5 are a $50 application fee plus a $50 annual license fee.

m. Licenses under § 29:26-8 run seasonally, starting no earlier than April 15 and ending no later than October 30 each year, and must be renewed annually; they are personal to the licensee and are automatically revoked if the related restaurant is sold or its lease transferred. Serving alcohol additionally requires separate approval from the Newark Alcohol Beverage Control Board under § 29:26-7. Before any license issues, § 29:26-9 requires a $2,000,000 commercial general liability policy naming the City as additional insured, from a carrier rated A or better by Best's, plus a hold-harmless agreement under § 29:26-10.
