Full Breakdown

City Code § 38-3.3 lets the director of engineering permit outdoor dining tables, chairs and related furniture in the public right-of-way outside a ground-floor restaurant or beverage establishment, as long as pedestrian and vehicular safety aren't compromised. Permits cost a $50 non-refundable application fee plus a $500 annual renewal fee. The dining area can extend up to half the sidewalk's width but must leave at least five feet of clear walking space, cannot be enclosed, and must be cleared away when the business is closed. The director may reduce the area or revoke the permit at any time.

Violations & Fines

Operating outdoor dining without a permit, or violating its conditions, lets the director revoke the permit at any time; noncompliant operators risk the chapter's general Class 4 misdemeanor penalty (§ 38-2).
