Outdoor dining is only allowed as 'an accessory use to a legally established eating and drinking establishment' on the same lot, an adjacent parcel, or the public right-of-way immediately next to the tenant space, per Section 16.330.02(C)(1). Hours are capped at whatever hours the indoor restaurant is open, 'unless otherwise specified in the zoning compliance review application' under (C)(2). On a public sidewalk, the seating area must stay enclosed and outside the pedestrian walk zone, keeping a four-foot clearance for ADA access, light poles, hydrants, and street furniture, or a two-foot minimum clearance if the seating sits at the curb, per (C)(3)(b). Where alcohol is served, physical barriers are required, and (C)(3)(c) specifies they must be 'durable material, not including plastic,' with 'no chain link fencing, chicken wire or cyclone fencing'; a permanent barrier bolted to the sidewalk needs public works review and must be removable with the sidewalk repaired afterward.

Furniture must be 'movable tables and chairs' of commercial grade, retractable awnings need eight feet of clearance on public sidewalks, and umbrellas cannot be vinyl. Safety rules under (C)(6) require fire access and hydrants to stay clear at all times, one 2A-10BC fire extinguisher within 75 feet of any point in the dining area, and flame-retardant tents that carry an SFM certification seal, with a fire department tent permit required above 400 square feet. Operators must steam-clean or pressure-wash the sidewalk area at least monthly and remove trash daily within 100 feet of the premises, per (C)(7)-(8).
