Summary

Anyone selling goods at a festival or a prearranged event of more than 100 people in Frederick County needs a vendor license under Code § 155-100F, at a flat $30 per festival or event. Vendors must register with and be approved by whoever is conducting the event, and the license does not carry over to a different festival.

These county ordinances apply to unincorporated areas of Frederick County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

F. Notwithstanding Subsections A through D of this section, each person who shall engage in or transact any business in this County for the sale of goods, wares and merchandise at a festival, as that term is defined in § 86-2 of this Code, or at any other prearranged event at a single location, whether indoors or outdoors, of more than 100 individuals, shall pay for such privilege a license tax of $30 per festival or event, which license shall not be prorated or transferable, and any such person shall have registered with and been approved by the person conducting the festival or event. No license shall be required under this subsection for i) vendors at flea markets under § 155-112 of this Code, who are to be licensed under that section, or ii) vendors who have otherwise obtained or are otherwise required to obtain a license pursuant to § 155-73 of this Code or pursuant to the laws or ordinances of any incorporated town located in Frederick County.

Full Breakdown

§ 155-100F of the Frederick County Code creates a separate license track for vendors selling goods, wares or merchandise at a 'festival' as defined in § 86-2, or at any other prearranged event at a single indoor or outdoor location drawing more than 100 people. The tax is a flat $30 per festival or event, nonproratable and nontransferable, so a vendor working three separate festivals in a year owes three separate $30 payments. Before selling, the vendor must register with and be approved by whoever is 'conducting' the event, a term § 155-100G defines to mean organizing, sponsoring, promoting, hosting or otherwise being responsible for the festival or event.

The subsection carves out two groups who do not need this specific $30 license: vendors at flea markets, who are licensed instead under § 155-112's separate flea-market schedule, and vendors who already hold or are required to hold a license under § 155-73 or under the ordinances of one of the county's incorporated towns. The $30 festival license does not replace the meals tax or the state sales and use tax; § 155-100F says expressly that it creates no exemption from either. A nonprofit organizer itself is exempt from the related carnival license under § 155-98D for events up to 10 consecutive days, and vendors participating solely to further that nonprofit's purpose are also exempt from that section's license; that carve-out sits in § 155-98, a different section from the § 155-100F festival-vendor tax.

Violations & Fines

Selling at a festival or qualifying prearranged event in Frederick County without the § 155-100F license, or without registering with the event's organizer, exposes a vendor to the general licensing penalty in § 155-110A: a fine of up to $2,500, up to 12 months in jail, or both. The county still collects the $30 tax, plus any owed meals or sales tax, even where the vendor never obtained the license.

Frequently Asked Questions

Do craft fair vendors need a license in Frederick County?
If the fair or festival draws more than 100 people, § 155-100F requires a $30 vendor license per event and registration with whoever is conducting the festival, unless the vendor already holds a flea-market license under § 155-112 or another license covering the sale.
Does the $30 festival license cover the meals tax?
No. § 155-100F states the vendor license creates no exemption from the county's meals tax or from the state sales and use tax, so a food vendor at a festival owes the $30 event license plus the meals tax on top of it.
Do nonprofit fundraiser events need vendor licenses?
A nonprofit organizer itself is exempt from the related carnival license under § 155-98D for events up to 10 consecutive days, and vendors participating solely to further that nonprofit's purpose are also exempt from that section's license; that carve-out sits in § 155-98, separate from the § 155-100F festival-vendor tax.
