Summary

Any concert, festival of arts, crafts or food, circus or similar outdoor event expected to draw more than 5,000 people a day in unincorporated Escambia County needs a county permit under the Outdoor Entertainment Event Ordinance, County Code § 86-212, applied for at least 60 days ahead with insurance and a security bond.

These county ordinances apply to unincorporated areas of Escambia County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

An outdoor entertainment event (hereinafter "event") is any concert, theatrical production, festival of arts, crafts, or food, circus, flight demonstration, holiday celebration, or similar event conducted outdoors, the primary purpose of which is to provide an opportunity for entertainment and appreciation of culture, education, arts, heritage, history or other similar purpose, where the daily attendance exceeds 5,000 people. ... No person, corporation, partnership, association or other organization shall conduct, or sell or furnish tickets for, an event in the county unless a permit has been obtained from the county. Any event authorized by the Santa Rosa Island Authority is exempt from this requirement.

Full Breakdown

The Outdoor Entertainment Event Ordinance, County Code §§ 86-210 through 86-221, covers any concert, theatrical production, festival of arts, crafts or food, circus, flight demonstration, holiday celebration or similar outdoor event whose daily attendance tops 5,000 people; events on county property or inside a certificate-of-occupancy venue built for crowds that size are exempt, and so is anything the Santa Rosa Island Authority separately authorizes. Organizers must apply at least 60 days before the event date, on the county administrator's form, paying an application fee set by the board of county commissioners and showing they have already contacted the Sheriff's Office, Public Safety/EMS/Fire Rescue/911/Emergency Management, building inspections, environmental services and the county risk manager. The application must name the event chairman, describe assembly, dispersal and parking plans, spell out amplified sound and loudspeaker use, and include a site plan reviewed by the Directors of Development Services and Environmental Services for stages, booths and lighting.

Before the county issues the permit, the applicant must carry insurance set by the county risk manager, delivered at least 30 days before the event with the county named as additional insured, and post a bond or cashier's check security, also due 30 days out, to cover cleanup and any county costs. All garbage and litter cleanup must be finished within 24 hours of the event's end, and every stage, booth, stand, sign and other movable fixture must come down immediately afterward. The county administrator can deny an application for good cause, including a felony conviction of moral turpitude by the applicant or an organization principal, and can revoke a permit already issued for noncompliance; a denial or revocation can be appealed to the board of county commissioners.

Violations & Fines

Holding an event covered by this ordinance without a permit is prohibited outright, and violating a permit's terms, in addition to any other county, state or federal law violation during the event, is enforced as a misdemeanor with the county free to seek injunctive relief under § 1-19 of the County Code on top of criminal prosecution under § 1-17.

Frequently Asked Questions

Does a small neighborhood festival need this permit?
Only if daily attendance is expected to exceed 5,000 people. County Code § 86-211 defines a covered 'outdoor entertainment event' by that attendance threshold, so most small block parties, church festivals and craft fairs fall outside the ordinance and don't need this specific county permit.
How far ahead do I need to apply for a festival permit?
At least 60 days before the event date, under § 86-213(a). The application needs an application fee set by the board of county commissioners plus proof you've already lined up support from the Sheriff's Office, fire rescue/EMS, building inspections, environmental services and the county risk manager.
What happens if I hold the event without a permit?
Section 86-221 prohibits any covered event until a permit is issued. Running one anyway, or breaking the permit's terms, is prosecuted like any other county ordinance violation, and the county can also pursue injunctive relief under § 1-19 of the Escambia County Code in addition to criminal charges.
