Its definition of special event names festivals, street fairs, art shows, outdoor concerts, parades and road races, and § 330-4 bars advertising or holding any such event until a permit has been issued. The application goes to the Township Manager's office on a form the Manager provides, no later than 30 days before the event. A late filing is accepted only at the Township Manager's discretion. The applicant must be at least 18, a separate adult must be named as the person in charge on the day, and the hours of operation cannot start before 8:00 a.m. or run past 10:00 p.m. The form also asks whether merchandise, food or beverages will be sold, whether an admission fee is charged, and how many participants are expected.
The Township Manager forwards the application to department directors. The Police Chief, the Chief of the Fire Bureau and the Code Enforcement Director make a public safety assessment, and the permit issues only on findings such as no diversion of police that would prevent normal protection for the Township, no unreasonable disruption of traffic, no unreasonable hardship to adjacent businesses or residences, and no extraordinary Township services. The decision comes within five business days of a completed application.
Under § 330-11 the Township Manager can add conditions: cones and barricades, first aid or sanitary facilities, special event monitors, limits on amplified sound, inspection of structures by the Fire Bureau, Monmouth County Health Department and Code Enforcement, and escrows against Township costs. Public Works cleans an under-cleaned site at the permit holder's expense. Section 330-14 requires $2,000,000 in general liability and $2,000,000 in auto liability, naming the Township of Howell as additional insured, filed no less than five days before the event. Section 330-6 adds that an event cannot exist solely to advertise products or for private profit, and homeowners' association approval is required where one applies.
Violations & Fines
Section 330-7 sets a fine of up to $2,000 for failing to comply with Chapter 330, expressly including holding a special event without a permit.
