Overland Park's zoning code treats festivals as a defined category of Special Event. 060, Type 3 Special Events include public events intended primarily for entertainment or amusement, such as concerts, festivals or sporting events that go beyond a facility's normal operation, temporary digital display or projected images, and recurring events meant to foster community spirit like a farmers market. These are allowed in Commercial and Industrial Districts, General Urban and Workshop Frontages in the Downtown Form District, and on non-residential uses within residential districts. A Type 3 event may run with a calendar of related promotional or entertainment activities so long as the whole program does not span more than one year, but it always needs a Special Event Permit issued before the event takes place, and that permit requires City Council approval.

The only carve-out is for one-day events: the Director of Planning and Development Services (or a designee) may approve those administratively when the event's small size, the capacity of the location, and any prior history make noise, traffic or crowd-control problems unlikely. 030 layers on general conditions that apply to every Special Event regardless of type: compliance with tent permits, temporary food service permits, temporary liquor licenses, noise regulations, parade permits and building codes unless a specific exemption is written into the permit, and promotional structures and activities must stay on private property unless specifically approved otherwise.
