Missouri Statewide Open Burning Air Quality Rule

10 CSR 10-6.045 establishes statewide restrictions on open burning. Prohibited materials include trade waste, tires, treated lumber, asphalt shingles, plastics, and any material producing dense smoke. Allowable burning includes recreational fires, agricultural operations, prescribed burns, and burning of untreated wood and yard waste outside ozone nonattainment areas. In St. Louis and Kansas City metropolitan ozone areas, additional seasonal restrictions apply during the April-September ozone season. Burning must not create a public nuisance or endanger persons or property under RSMo 260.211.

Civil penalties up to $10,000 per day under RSMo 643.151. Criminal misdemeanor charges may apply for repeat violations or burning prohibited materials.
