Floodplain Development Standards in New York

Environmental Conservation Law Article 36 directs DEC to coordinate the state floodplain management program and requires participating communities to adopt local laws meeting NFIP minimums. The Uniform Fire Prevention and Building Code under Executive Law Article 18 incorporates ASCE 24 flood-resistant construction standards that apply statewide outside NYC. Substantial improvement and substantial damage rules, base flood elevation, and freeboard requirements are uniform. Municipalities may adopt higher standards but cannot weaken the state and federal baseline without losing NFIP eligibility.

Building in a Special Flood Hazard Area without an elevation certificate or below the required base flood elevation can void flood insurance, trigger code enforcement orders, and result in civil penalties. Communities that fail to enforce can be suspended from NFIP, ending federally backed insurance and disaster aid.
