Virginia Personal Marijuana Home Cultivation Limits

Va. Code Section 4.1-1101 permits any person 21 or older to cultivate up to four marijuana plants per household for personal use at their primary residence. Plants must be tagged with the grower's name, driver's license or ID number, and a notation that the plants are for personal use. Plants must not be visible from public view and must be kept where minors cannot access them. Sale or transfer remains prohibited outside the licensed retail framework. The cap is per household, not per adult.

Exceeding four plants is a civil penalty for first offense, escalating to a Class 3 misdemeanor for repeat violations and Class 1 for distribution-scale grows.
