Under VA Code Section 4.1-1101 and following (passed in 2021 as HB 2312/SB 1406), Virginia allows adults 21 and older to possess up to 1 ounce of cannabis in public and grow up to 4 cannabis plants per household (not per person) for personal use at their primary residence. Plants must be: tagged with the grower's name, driver's license or ID number, and a notation that they are for personal use; out of public view (not visible from the street or public spaces); inaccessible to persons under 21; and not cultivated for sale. Renters may need landlord permission, and HOAs can restrict cultivation. Chesapeake cannot lawfully prohibit what state law allows but can enforce zoning rules on odors and ventilation that apply generally. Public consumption, consumption in vehicles, and any sale remain illegal. Legal retail sale of recreational cannabis has not launched in Virginia as of the current date.
