Summary

Virginia law prohibits homeowner and condominium associations from banning electric vehicle charging stations on a unit owner's exclusive-use property, though associations may impose reasonable conditions on installation and operation.

§ 55.1-1962.1 . Electric vehicle charging stations permitted. A. Except to the extent that the condominium instruments provide otherwise, no unit owners' association shall prohibit any unit owner from installing an electric vehicle charging station for the unit owner's personal use within the boundaries of a unit or limited common element parking space appurtenant to the unit owned by the unit owner. B. Notwithstanding any other provision of this chapter or the condominium instruments, the unit owners' association may prohibit a unit owner from installing an electric vehicle charging station if installation of the electric vehicle charging station is not technically feasible or reasonably practicable due to safety risks, structural issues, or engineering conditions. C. The unit owners' association may require as a condition of approving installation of an electric vehicle charging station that the unit owner: 1. Provide detailed plans and drawings for installation of an electric vehicle charging station prepared by a licensed and registered electrical contractor or engineer familiar with the installation and core requirements of an electric vehicle charging station. 2. Comply with applicable building codes or recognized safety standards. 3. Comply with reasonable architectural standards adopted by the unit owners' association that govern the dimensions, placement, or external appearance of the electric vehicle charging station. 4.

Full Breakdown

Code §§ 55.1-1823.1 (property owners' associations) and 55.1-1962.1 (condominiums) bar an association from prohibiting an owner from installing an electric vehicle charging station for personal use on property the owner owns or has exclusive use of, unless the recorded declaration provides otherwise. The association may set reasonable restrictions on the number, size, place, and manner of installation, may require the owner to carry insurance naming the association as an additional insured, and may require indemnification. An association may restrict or prohibit charging stations on the common area.

Violations & Penalties

HOAs that flatly deny EV charging requests violate state law and may face injunctive relief plus owner attorney fees.

Frequently Asked Questions

Can my HOA refuse to let me install a Level 2 charger in my garage?
Generally no. Unless the recorded declaration prohibits it, § 55.1-1823.1 bars the association from denying an EV charging station on your own lot or assigned parking. The association may set reasonable installation conditions and require insurance.
Does this apply to renters?
The HOA protection runs to unit owners. Renters must work with their landlord; Virginia has no statewide tenant EV-charging right yet, so check the lease.
