In Eagan, an above-ground pool needs a building permit unless it holds less than 5,000 gallons AND is less than 24 inches deep. It can skip the perimeter fence if it has at least 4-foot walls plus a self-latching lockable gate, or if the only access is a removable ladder taken away when not in use. Setbacks still apply.
The City of Eagan treats above-ground pools under the same Swimming Pool, Hot Tub, and Whirlpool guidance as in-ground pools, with two key distinctions. First, on permits: a building permit is required for all pools 'EXCEPT above ground pools containing less than 5,000 gallons of water and less than 24" deep.' So a typical full-size above-ground pool (which usually exceeds those thresholds) does require a permit. Second, on barriers: above-ground pools are exempt from the perimeter fence requirement if they have 'at least 4-foot high vertical walls or outward inclined side walls and a self-closing and self-latching lockable gate or sole access is by means of a removable ladder, ramp, or stairs, which must be removed when the pool is not in use.' All other location rules still apply: the pool must sit at least 5 feet from any side or rear lot line, must be in a side or rear yard (not the required front yard setback), cannot encroach into easements, and cannot be within 10 feet of overhead utility lines or over underground lines. Electrical work serving the pool must meet the National Electrical Code, and structural/installation work falls under the Minnesota State Building Code that Eagan enforces.
Installing a permit-required above-ground pool without a permit, or relying on the fence exemption without an actual 4-foot wall plus a self-latching gate or a removed ladder, can result in enforcement, after-the-fact permitting, and orders to add a compliant barrier. Placing the pool in an easement or front yard setback can force relocation.
