Eagan requires in-ground pools to be enclosed by a fence at least 4 but not more than 6 feet high, at least 4 feet from the pool edge, with the bottom no higher than 4 inches above ground. Gates must be self-closing, self-latching, and lockable. Above-ground pools with 4-foot walls and a removable/locked ladder may be exempt.
According to the City of Eagan's pool guidance, standard in-ground pools must be enclosed by a fence 'at least 4, but not more than 6 feet high,' located 'at least 4 feet from the edge of the pool,' with the bottom 'not be higher than 4 inches above the surface' of the ground. Gates must be 'self-closing and self-latching lockable gates,' and the fence material must be of the 'non-climbing type, impenetrable by toddlers and afford no external hand or footholds.' Above-ground pools are exempt from the perimeter fence requirement if they have 'at least 4-foot high vertical walls or outward inclined side walls and a self-closing and self-latching lockable gate or sole access is by means of a removable ladder, ramp, or stairs, which must be removed when the pool is not in use.' These residential barrier rules are Eagan's own City Code provisions. Minnesota Rules part 4717.1550 sets separate, generally stricter fencing standards (5 feet high for outdoor pools) but that rule governs public/regulated pools, not private residential backyard pools. New residential pool barriers are also subject to the Minnesota State Building Code, which incorporates pool/spa barrier standards based on the International Swimming Pool and Spa Code.
A pool without a compliant barrier will fail final inspection and cannot be lawfully filled or used. Missing self-closing/self-latching gates, climbable fencing, or gaps exceeding the 4-inch ground clearance must be corrected. An unsecured pool also creates an attractive-nuisance liability exposure for the owner.
