Eagan, MN Swimming Pools & Spas: Pool Permits (2026)

Per the City of Eagan's Swimming Pool, Hot Tub, and Whirlpool guidance, a structure 'containing artificial water for swimming/bathing deeper than 24 inches and exceeding 150 square feet in surface area' is regulated as a pool. A building permit is required for all pools 'EXCEPT above ground pools containing less than 5,000 gallons of water and less than 24" deep.' Applicants must submit two copies of plans plus one site plan showing pool location, fence placement, drainage, elevations, setbacks, and distances to lot lines and structures. Pool interior walls must sit at least 5 feet from any side or rear lot line, cannot encroach into easements, and must be in side or rear yards (not the required front yard setback). No pool may be placed beneath or within 10 feet of overhead utility lines or over underground lines. Electrical work must meet the National Electrical Code, and pool heaters require an approved pressure relief valve. Permits are valid for 180 days from issuance. Inspections (forming, piping air test, final) are scheduled at 651-675-5675. Building construction itself follows the Minnesota State Building Code, which Eagan administers as the local jurisdiction.
