For an above-ground pool with walls at least 48 inches high, the pool wall can serve as the barrier provided the ladder is removable or can be secured when the pool is not in use, and any attached deck or steps are gated - consistent with the 2022 California Residential Code Appendix AX and Health & Safety Code 115923.
Installing an above-ground pool over the 24-inch/5,000-gallon threshold without a permit is a stop-work item subject to corrective-permit fees under the adopted California Building Code. Leaving an access ladder in place on a barrier-by-wall pool when unattended can be pursued as a code-compliance issue because it defeats the required barrier. The pool cannot be finaled until it passes barrier inspection.
