Above-ground pools in Ventura are treated as 'swimming pools' under California law and the City's building code: any structure intended for swimming or recreational bathing that contains water more than 18 inches deep falls within Health & Safety Code §115921(a) and triggers permit, barrier, and SB 442 dual-feature requirements. The City's FAQ confirms that spas, hot tubs, and above-ground prefabricated plastic pools require a permit. Where the wall of the above-ground pool itself serves as the barrier (or the barrier is mounted on top of the pool structure), and the means of access is a ladder or steps, the ladder/steps must be either secured, locked, or removable to prevent access — or surrounded by a compliant 60-inch barrier. When the ladder is secured/locked/removed, any resulting opening may not allow passage of a 4-inch sphere (BS 316 item 7; CBC §3109.4.1.6).
California law treats an above-ground pool the same as an in-ground pool once the water exceeds 18 inches in depth (HSC §115921(a)). Ventura's Building & Safety FAQ on permit types states: 'Spas, hot tubs and above ground plastic pools (if prefab) require permits, and new electrical and gas lines will require permits.' That means an above-ground pool installation in Ventura needs: (1) a Building & Safety permit (with site plan per BS 519 if applicable), (2) electrical permit for the pump/heater and equipotential bonding, (3) gas permit if a gas heater is installed, (4) compliance with SB 442's two-feature rule at permit issuance. For the barrier, BS 316 item 7 (mirroring CBC §3109.4.1.6) sets two alternative paths: (a) the ladder or steps shall be capable of being secured, locked, or removed to prevent access; OR (b) the ladder/steps shall be surrounded by a barrier meeting all of the standard barrier requirements (60-inch height, 1¾-in vertical-member spacing, etc.). Either way, when the ladder is secured, locked, or removed, any opening that exists must not permit a 4-inch sphere to pass. The above-ground pool's exterior wall must itself be at least 60 inches above grade on the outside to substitute for a fence. SB 442's dual-feature rule still applies: a single locked ladder counts as one feature; an ASTM F1346 safety cover, a pool alarm meeting ASTM F2208, or removable mesh fencing per ASTM F2286 are common second-feature additions for above-ground installs. Setbacks from property lines and from the dwelling apply per Title 24 Zoning standards for accessory uses; check the specific residential-zone chapter for the parcel. Electrical bonding of the pool shell, deck, and equipment per CEC Article 680 is required.
Installing an above-ground pool over 18 inches deep without a Building & Safety permit; failing to provide a 60-inch barrier or compliant pool-wall substitute; leaving a ladder accessible without securing, locking, or removing it; allowing openings >4 inches when the ladder is retracted; failing to provide a second SB 442 feature; or installing pool electrical equipment without permits and Article 680 bonding. Code-enforcement and Building & Safety stop-work authority apply.
