Under SB 442 (2017), every new or remodeled residential pool or spa at a private single-family home permitted on or after January 1, 2018 must be equipped with at least TWO of seven approved drowning prevention features. The City's handout BS 316 illustrates four compliance options: (1) full perimeter fencing of the pool/spa only; (2) ASTM F1346 powered safety cover plus yard fencing; (3) audible exit alarms on every house door accessing the pool plus yard fencing; (4) self-closing/self-latching doors plus yard fencing. Suction outlets must comply with ANSI/APSP-16 entrapment protection (CBC §3109.4.4.8). Final inspection by Building & Safety verifies the elected features.
Per HSC §115922(a), the seven approved drowning prevention features are: (1) an enclosure that isolates the pool/spa from the dwelling and meets HSC §115923; (2) removable mesh fencing complying with ASTM F2286 with a self-closing/self-latching gate that can accommodate a key-lockable device; (3) an approved safety pool cover (ASTM F1346); (4) exit alarms on the private single-family home's doors that provide direct access to the pool/spa — the alarm must produce an audible warning when the door and/or screen is opened, listed/labeled to UL 2017, with a deactivation switch at least 54 inches above the threshold; (5) a self-closing, self-latching device on the dwelling's doors providing direct access to the pool with the release mechanism no lower than 54 inches above the floor; (6) an alarm capable of detecting unauthorized entry into the water (typically a surface or sub-surface pool alarm meeting ASTM F2208); (7) other means of protection providing equivalent protection approved by the local building code official. Building & Safety verifies at final inspection that at least TWO of these are installed and operating, and the inspector documents the elections on the Pool Safety Certificate. The regional Pool Safety Certificate (used by Ventura County Building & Safety and applied by City building officials) is signed by the property owner and contractor and kept with the permit record. Suction outlet entrapment protection under CBC §3109.4.4.8 / ANSI/APSP-16 requires dual main drains, anti-entrapment covers, or safety vacuum release systems — these are enforced even for single-feature compliance scenarios. Ventura's BS 316 explicitly warns that all doors providing access to the pool — including sliding glass doors and any garage door allowing pool access — must be alarmed if Option 3 is chosen.
Failing to install at least two HSC §115922 drowning prevention features at permit issuance; disabling, removing, or replacing a previously-required safety feature without a new permit; non-compliant suction outlets; filling a pool before final safety inspection. Building & Safety may withhold Certificate of Final Inspection until corrected; HSC §115922 is enforced as a precondition to permit issuance and final approval. Additional civil liability may attach to homeowners who knowingly disable safety features.
