Hot tubs and spas in Ventura are 'swimming pools' under Cal. Health & Safety Code §115921(a) when the water exceeds 18 inches deep, but they receive a critical relief: CBC §3109.4.4.2 (mirrored by BS 316) exempts a spa or hot tub from the perimeter barrier requirement if it has a safety cover complying with ASTM F1346. The City's Building & Safety FAQ confirms that spas, hot tubs, and above-ground plastic pools all require permits — including separate electrical and gas permits for the equipment. SB 442's dual-feature rule (HSC §115922) still applies when a building permit is issued, but an ASTM F1346 locking safety cover satisfies one feature on its own and may, in combination with other elections, complete the two-feature requirement. Equipment enclosures must be set back from openable windows of nearby dwellings to manage combustion air and noise.
California treats spas and hot tubs as 'pools' once water depth exceeds 18 inches (HSC §115921(a)). The CBC §3109.4.4.2 spa exception — adopted in BS 316 — provides that 'spas or hot tubs with a safety cover which complies with ASTM F 1346 shall be exempted' from the standard barrier requirements; the City's site-plan note 5 reinforces that spas may use approved locking safety covers in lieu of a perimeter fence. Despite the barrier exemption, the unit must still meet: (1) Building & Safety permit issuance with electrical, gas, and plumbing trade permits as applicable; (2) SB 442 dual-feature rule at permit issuance if it qualifies as a pool/spa under §115921 and the permit is on/after 1/1/2018 — an ASTM F1346 cover counts as one feature; common second-feature pairings are exit alarms on dwelling doors, self-closing dwelling doors with high latches, or an enclosure; (3) CEC Article 680 electrical bonding and GFCI protection of the spa, equipment, and surrounding deck; (4) entrapment-protected suction outlets per ANSI/APSP-16 (CBC §3109.4.4.8); (5) for gas-heated spas, the heater must be sited so combustion air is unobstructed and at the City-required distance from openable windows of dwellings (BS 519 callout F requires the heater-to-window distance to be shown on the site plan). Zoning setbacks for accessory equipment, side/rear-yard requirements, and noise (SBMC Ch. 10.650) apply — pump and heater operation must conform to Ventura's noise zones. Spas installed indoors must comply with CBC §3109.4.1.8 wall provisions. Removable mesh fencing (ASTM F2286) and exit-door alarms (UL 2017, deactivation switch ≥54 in above threshold) remain available as alternative SB 442 features. Coastal-zone spa installations may have additional Coastal Commission notification requirements where view corridors or bluff setbacks are affected.
Installing or replacing a hot tub or spa without a Building & Safety permit; relying on a non-ASTM F1346 cover to claim the §3109.4.4.2 barrier exemption; failing to install at least two SB 442 features at permit issuance; placing a gas heater without required combustion-air clearance from openable windows; missing CEC Article 680 bonding or GFCI protection; non-compliant suction outlets; or operating equipment in violation of SBMC Ch. 10.650 noise standards. Building & Safety may withhold final inspection or issue Stop Work Orders; code-enforcement abatement applies to operating units.
