Failure to maintain a compliant barrier can trigger building-code nuisance abatement and civil liability for drownings. A fence under 6 feet typically does not require a separate fence permit in Concord, but pool enclosures must meet the specific pool-barrier geometry above regardless of normal fence allowances.
