Residential swimming pools and spas in Brentwood must meet California Health and Safety Code Section 115920 through 115929, which requires at least two of seven enumerated safety features. Barriers must be at least 60 inches high, have self-closing and self-latching gates opening away from the pool, and have no climbable features. Requirements are verified at building permit inspection.
California has preempted pool barrier regulation through the Swimming Pool Safety Act at Health and Safety Code Sections 115920 through 115929. Brentwood enforces these standards through the Building Division at plan check and final inspection for any new pool, spa, or major remodel. For pools constructed, installed, or remodeled after January 1, 2018, the owner must equip the pool with at least TWO of the following seven safety features: (1) an enclosure that isolates the pool from the private single-family home, meeting specific height, gate, and opening requirements; (2) removable mesh fencing meeting ASTM F2286 with a self-closing, self-latching gate meeting ASTM F2090; (3) an approved safety pool cover meeting ASTM F1346; (4) exit alarms on the private single-family home doors providing direct access to the pool; (5) self-closing, self-latching devices with a release mechanism at least 54 inches above the floor on doors providing direct access from the home to the pool; (6) an alarm that, when placed in the pool, sounds upon detection of accidental or unauthorized entrance; or (7) other means of protection providing equal or greater protection approved by the ASTM. The isolation fence (Option 1) must be at least 60 inches high measured from the outside, have a maximum 2 inch gap at the bottom, have no openings greater than 4 inches, and have a gate that is self-closing and self-latching, opens outward away from the pool, and has a latch at least 60 inches above the ground. Climbable features (horizontal members, planters, equipment) within 24 inches of the barrier are prohibited. For real estate transactions, Civil Code 1102.16 and HSC 115925 require disclosure of pool safety compliance at sale. Noncompliance with Section 115920 et seq. can result in stop-work orders, failure to obtain a final, and civil liability if a drowning or near-drowning occurs.
