515.27 Residential swimming pool safety feature options; penalties. — (1) In order to pass final inspection and receive a certificate of completion, a residential swimming pool must meet at least one of the following requirements relating to pool safety features: (a) The pool must be isolated from access to a home by an enclosure that meets the pool barrier requirements of s. 515.29. (b) The pool must be equipped with an approved safety pool cover. (c) All doors and windows providing direct access from the home to the pool must be equipped with an exit alarm that has a minimum sound pressure rating of 85 dB A at 10 feet.
Full Breakdown
Chapter 6 adopts the Florida Building Code, as adopted and amended from time to time by rule of the Florida Building Commission under F.S. Chapter 553, and uses it to administer and enforce building regulation in the city. Under section 6-3(b) you must apply to the building official and obtain a permit before constructing or altering a structure, or installing any electrical, gas, mechanical or plumbing system, unless the Florida Building Code specifically exempts the work. The city fence section states expressly that it does not supersede state requirements for fencing around swimming pools. The substantive pool safety standards therefore sit in state law rather than in this code.
Violations & Fines
Starting work before the permit issues doubles the permit fees under section 6-3(c)(1). Building code violations are declared a public nuisance and penalized under section 1-9.
