Hendersonville pool barriers are governed by Section 305 of the 2021 International Swimming Pool and Spa Code as adopted by the City effective July 1, 2025. Barriers must be at least 48 inches above grade on the side facing away from the pool, openings may not allow a 4-inch sphere to pass, gates must be self-closing, self-latching, and open outward away from the pool, and the latch must be at least 54 inches above the bottom of the gate. The City's Swimming Pool Plan Submittal Checklist independently requires applicants to show 'Pool fencing design and location to show enclosure around pool area' and 'All gates to indicate swing away from pool.'
ISPSC Section 305 as adopted by the City of Hendersonville sets the controlling barrier rules. (1) Height: 'The top of the barrier shall be at least 48 inches (1219 mm) above grade where the measurement is taken on the side of the barrier which faces away from the swimming pool.' (2) Ground clearance: the maximum vertical clearance at the bottom of the barrier is 2 inches measured on the side facing away from the pool (or 4 inches when the top of an above-ground pool structure is at least 48 inches above grade). (3) Openings: 'Openings in the barrier shall not allow the passage of a 4-inch-diameter (102 mm) sphere.' (4) Solid barriers: 'Solid barriers which do not have openings, such as a masonry or stone wall, shall not contain indentations or protrusions except for normal construction tolerances and tooled masonry joints.' (5) Spacing for horizontal/vertical fences: where horizontal members are less than 45 inches apart, the horizontal members shall be on the swimming pool side and spacing between vertical members shall not exceed 1-3/4 inches; where horizontal members are 45 inches or more apart, spacing between vertical members shall not exceed 4 inches. (6) Chain-link: 'Maximum mesh size for chain-link fences shall be 1-1/4-inch (32 mm) square unless the fence is provided with slats fastened at the top or the bottom which reduce the openings to not more than 1-3/4 inches (44 mm).' (7) Diagonal members: maximum opening formed by diagonal members shall not be more than 1-3/4 inches. Gates per ISPSC 305.3: shall comply with the barrier requirements; pedestrian access gates shall open outward away from the pool, shall be self-closing and self-latching, and shall be equipped with a locking device; if the release mechanism is located less than 54 inches from the bottom of the gate, it shall be located on the pool side of the gate at least 3 inches below the top of the gate, and the gate and barrier shall have no opening greater than 1/2 inch within 18 inches of the release mechanism. ISPSC 305.4 (Dwelling wall as a barrier): where a wall of a dwelling is part of the barrier, doors with direct pool access must have a UL 2017 alarm, an ASTM F 1346 powered safety cover, a self-closing/self-latching device with the release at least 54 inches above the floor, or other approved means. The City's Plan Submittal Checklist independently requires the pool fencing and gate-swing direction to be shown.
Failure to maintain a compliant barrier is the most common pool-code violation. Self-closing gates that have failed, latches below 54 inches not on the pool side, openings over 4 inches, barriers under 48 inches, gates that swing toward the pool, and climbable objects (chairs, ladders, AC units, planters) within reach of the barrier all trigger code-enforcement action. Building & Codes may require the pool to be drained or covered until violations are corrected.
