N.J.A.C. 5:23 (New Jersey Uniform Construction Code) requires all swimming pools deeper than 24 inches to be completely enclosed by a barrier (fence) at least 4 feet high. The barrier must have a self-closing, self-latching gate that opens away from the pool. Gate latches must be at least 54 inches from the ground or on the pool side of the fence. The barrier must prevent access by young children and must be inspected and approved before the pool can be filled and used. Jersey City enforces these state requirements through Chapter 131 (Uniform Construction Code). Above-ground pools with decking may use the deck structure as part of the barrier if it meets access restriction requirements.
