Lincoln has no city-specific barrier ordinance; instead Title 15 of the Lincoln Municipal Code adopts the California Building Code (CBC) and California Residential Code (CRC), which incorporate the Swimming Pool Safety Act. Per Cal. Health & Safety Code Section 115923 the required enclosure must: (a) be a minimum of 60 inches high, (b) have a maximum 2-inch vertical clearance from grade to bottom of enclosure, (c) have gaps that do not pass a 4-inch sphere, (d) have an outside surface free of handholds/footholds, and (e) have any access gate open away from the pool and be self-closing with a self-latching device placed no lower than 60 inches above the ground. These requirements are inspected by Lincoln Building Division before final approval of the pool permit.
Failure to maintain a code-compliant barrier is a Building Code violation; the Building Official can issue a Notice of Violation, withhold final inspection, and refer enforcement under LMC Title 1. Civil liability under the Swimming Pool Safety Act may also attach.
