Loveland enforces the 2024 ISPSC residential pool barrier requirements through LMC Chapter 15.54. ISPSC Section 305 (Barrier Requirements) applies to all residential pools and spas more than 24 inches deep: a barrier at least 48 inches above grade measured on the exterior side, ground clearance no more than 2 inches above grade, no openings allowing passage of a 4-inch-diameter sphere, climbable horizontal-member spacing rules (no horizontal members within 45 inches of each other on the exterior, or vertical-member spacing no more than 1.75 inches), and self-closing/self-latching gates with the release at least 54 inches above ground.
LMC 15.54.010 adopts ISPSC 2024 (excluding appendices). ISPSC Section 305.2.1 requires the top of the barrier to be at least 48 inches above grade measured on the side facing away from the pool. Section 305.2.2 limits ground clearance below the barrier to 2 inches above grade on the exterior side (or 4 inches above grade in a concrete deck context). Section 305.2.3 prohibits openings that allow passage of a 4-inch-diameter sphere. Section 305.2.4 (solid barriers) prohibits indentations or protrusions other than normal masonry tooled joints. Section 305.2.5 (horizontal-member spacing): where horizontal members are spaced less than 45 inches apart, they shall be on the swimming-pool side of the fence and vertical members shall be spaced no more than 1.75 inches apart; where 45 inches or more apart, vertical-member spacing no more than 4 inches. Section 305.2.6 (chain-link): mesh size no larger than 1.75 inches square unless reduced with slats. Section 305.3 (gates): self-closing and self-latching, opening outward away from the pool; the release mechanism at least 54 inches above the ground, or - if installed on the pool side - on the inside of the gate with no opening greater than 0.5 inch within 18 inches of the release. Section 305.4 (dwelling wall as barrier): doors with direct access to the pool must be equipped with an alarm or self-closing/self-latching device or be separated from the pool by a sub-barrier. Hot tubs and spas with safety covers meeting ASTM F1346 are exempt from the barrier requirement under ISPSC Section 305.6.
LMC 15.54.030 declares any work contrary to the adopted ISPSC unlawful and a misdemeanor subject to LMC 1.12.010 penalties. The Building Division may order correction of barrier defects before issuing a certificate of occupancy or final inspection sign-off.
