Modesto requires all swimming pools to have safety barriers per California Building Code (CBC) Chapter 31. Pool barriers must be at least 5 feet high with self-closing, self-latching gates. All openings must prevent passage of a 4-inch sphere.
All residential swimming pools, spas, and hot tubs in Modesto must comply with California Building Code Chapter 31 pool barrier requirements. Barriers (fences, walls, or a combination) must be at least 60 inches (5 feet) high. Gates must be self-closing and self-latching, with the latch at least 54 inches above the ground. All openings in the barrier must be small enough to prevent passage of a 4-inch sphere. The barrier must completely surround the pool with no gaps allowing direct access from the house to the pool area without passing through a gated barrier. Alternatively, an approved pool safety cover, pool alarm, or door alarms on house exits to the pool may serve as one layer of a multi-layered protection system. Building permits are required for all new pools.
Non-compliant pool barrier: notice to correct. Failure to comply: fines and potential red-tag of pool for use until corrected.
