A new or remodeled Napa pool with an enclosure under 60 inches, climbable horizontals, openings larger than 4 inches, or a non-self-latching gate violates H&S 115923 and CBC 3109. The Building Division will not finalize the permit; ongoing failures create attractive-nuisance civil liability and possible owner liability under California Civil Code 1714.
