SRMC § 12.265.020, amending Section 305.2 of the adopted International Swimming Pool and Spa Code, requires every owner or possessor of land with a private swimming pool to secure it from unauthorized entry with an enclosure meeting all the requirements of Health and Safety Code § 115923: the statewide Swimming Pool Safety Act standard covering self-closing, self-latching gates and comparable barrier features. Existing pools that don't conform must be brought into compliance within ninety days, though the chief building official can grant an exception if an alternative barrier provides equal protection. The enclosure is separate from and additional to the 'safety features' required under Health and Safety Code § 115922; the zoning code's fence chapter (§ 14.16.140.C.2.a) also confirms pool fences are governed by the building code.
