The Florida Residential Swimming Pool Safety Act (FS 515) is enforced locally by the Seminole Building Department under Chapter 6. Every new residential pool must be enclosed by a barrier at least 48 inches high measured from the outside, with no gaps, indentations, or footholds permitting child access. Gates must be self-closing, self-latching, and open outward. As an alternative, the home wall may serve as part of the barrier if all doors leading to the pool have exit alarms producing 85 decibels or self-closing/self-latching devices 54 inches above the floor. A safety pool cover meeting ASTM F1346 is also acceptable. Final inspection includes a barrier compliance check.
Failure to maintain compliant barriers can result in code enforcement citations, civil penalties under FS 162, denial of certificate of completion, and potential criminal charges under FS 515.27.
