Clearwater applies Florida Statutes Chapter 515 and the Florida Building Code to all new residential pools. Barriers must be at least 48 inches high measured from the outside, contain no gaps wider than four inches, and have gates that open outward, self-close, and self-latch with the latch at least 54 inches above the ground. Alternative compliance options include approved pool covers, exit alarms on doors leading to the pool area, and self-closing/self-latching devices on dwelling doors. Clearwater Community Development Code Division 8 also regulates fence height, location, and permits.
A pool cannot pass final inspection without a compliant barrier, and ongoing failure to maintain barriers is a code-enforcement violation that can result in daily fines and second-degree misdemeanor charges under state law.
