Suffolk County pool barriers must comply with NY State Uniform Code sec. 326 and 2020 Residential Code Appendix G: 48-inch minimum barrier, self-closing and self-latching gates, no climbable features within 4 feet of exterior, maximum 4-inch gap under barrier, maximum 1-3/4 inch picket spacing.
All Suffolk County towns enforce NY Uniform Code barrier requirements: minimum 48 inches high measured from grade outside the barrier. Gate latches minimum 54 inches above grade on pool-side of gate, self-closing and self-latching. If the house wall serves as part of the barrier, doors opening to the pool area require an alarm or self-closing device. Mesh fencing must meet ASTM F2286. Chain-link must have maximum 1-3/4 inch mesh. Pool must have barrier during construction (temporary fencing). Power safety covers (ASTM F1346) satisfy barrier requirement only for spas/hot tubs. No local Suffolk County town waives the 48-inch requirement.
Inadequate barrier: 500-2,500 dollars fine, pool closure order until compliance. Drowning incident at non-compliant pool: civil liability plus potential criminal negligence charges.
