Pool barriers are required under Tigard Building Code and the International Swimming Pool and Spa Code. Oregon state rules (OAR 333-060-0105) require 42-inch minimum barriers with self-closing, self-latching gates. Gates must swing outward from the pool area.
Swimming pool enclosures must have gates with self-latching devices with operating controls at least 42 inches above the exterior ground surface. Gates must swing away from the pool enclosure. All exterior projections or recessions must be 42 inches from either the top or bottom of the fence. Pool barrier fences require building permits regardless of height.
Non-compliant barriers: immediate correction. Fines $100 to $500. Significant liability for drowning incidents.
