Hot tubs and spas 24 inches or more in depth require a building permit and Cook County Health Department approval in unincorporated areas. Equipment must be at least 10 feet from property lines. Underground service lines must be at least 5 feet and overhead lines at least 10 feet from the spa edge.
Cook County requires permits for spas and hot tubs that are 24 inches or more in depth in unincorporated areas. Applications are submitted through the Department of Building and Zoning e-Permit system. A pool permit requires Cook County Department of Public Health (CCDPH) approval prior to applying with Building and Zoning. CCDPH reviews residential pools and spas to be constructed in unincorporated suburban Cook County. Key requirements include: the spa and equipment must be more than 10 feet from any property line; the spa must have an impervious surface; underground service lines must be at least 5 feet from the spa edge; overhead service lines must be at least 10 feet horizontally from the inside edge of the spa. Spas must comply with residential swimming pool barrier requirements: a fence or barrier at least 3.5 feet tall with no openings greater than 4 inches and self-closing, self-latching gates. The residential deposit for permits is $100.
Unpermitted spa installation: fine of $500-$2,000. Non-compliance with barrier requirements: corrective action required within 30 days. Health code violations enforced by CCDPH.
