Section 7-11(a) of the General Ordinances requires a permit "before beginning construction, alteration, or repair of any building or structure," issued by the Building Commissioner or designated Community Development Services, Planning Division staff, with fees paid to the City per the schedule in Section 4-66. Permits are valid 365 days, with one 365-day extension available at half the base fee, and construction must begin within 45 days of issuance or the Building Commissioner may revoke it. Section 10-03-13(B) then sets the pool-specific rules: private pools "shall conform to the current Indiana Building Code," are "permitted in the side or rear yards only and must be set back at least ten feet (10') from side and rear property lines," and must drain by a suitable method that never discharges into the sanitary sewer or onto neighboring property.

Section 7-12 requires the permit application include a plat or sketch showing lot boundaries and plans for the work, reviewed within 30 business days (or 48 hours for an expedited fee under Section 7-14). Section 7-13 then requires the Building Commissioner conduct at least three inspections, footing, rough-in and final, before the pool can be used. Anyone starting pool construction before the permit issues is charged twice the normal permit fee under Section 7-14(a).
