Section 98-2021 of the Hialeah Code of Ordinances requires that permits be secured before any work begins on a swimming pool and on the pool's safety barrier; plans submitted with the application must show compliance with the barrier standards set out in the surrounding subdivision. The section links the two permits together: no swimming pool permit can be issued unless a safety-barrier permit is obtained simultaneously, so a homeowner cannot get pool construction approved without also committing to the fencing or wall required around it.

There is one carve-out. If the property is already enclosed as required by the subdivision, the safety-barrier permit is not required, but only after a city inspection confirms the existing barrier is satisfactory; the discretion to approve or reject that existing barrier rests with the director of planning and development under the neighboring Sec. 98-2023. Once a permit issues, the barrier itself must meet the construction specifications in Sec. 98-2022 (nonclimbable wood, block or two-inch chain-link fencing) and the setback rule in Sec. 98-2025, which sets a ten-foot minimum from an interior side property line, 20 feet from a side street property line, and 7½ feet from a rear property line for R-1 through R-4 districts.

Under Sec. 98-2024, any pool deeper than 18 inches or with more than 250 square feet of surface area must have its approved barrier in place before the pool is filled with water, tying the permit process directly to when the pool can be filled.
