Kenosha, WI Swimming Pools & Spas: Pool Permits (2026)

Section 9.18 of the Building Code requires a permit before any swimming pool, hot tub or spa is constructed, built, rebuilt, altered, modified or improved in Kenosha. Section 9.18.A specifically requires the applicant to possess a valid Wisconsin Master Electrician's License, tying the permit to the electrical work the installation involves. The application under Section 9.18.B must be fully completed and include a Site Plan along with plans and specifications for the proposed work. No pool, hot tub or spa may be used until the Code Official has inspected and approved the installation as conforming to the Code and has issued an insignia of approval, which Section 9.18.C requires be permanently and conspicuously affixed.

Section 9.18.D.1 requires electrical conductor clearance from overhead or underground lines, whether private or utility-owned, to conform with SPS 316 of the Wisconsin Administrative Code and Article 680 of the National Electrical Code, and Section 9.18.F separately adopts SPS 316 and NEC Article 680 by reference for wiring and equipment. As a trade-off for the permitting burden, Section 9.18.D.2 exempts swimming pools, hot tubs and spas from the City's maximum lot coverage zoning limit. Section 9.18.G requires draining to avoid creating a nuisance, flowing onto adjacent property without consent, creating a right-of-way hazard, or entering the sanitary sewer.
