Summary
Building a swimming pool or spa in unincorporated Yuba County means meeting two sets of county rules at once: the zoning setbacks in Yuba County Code Section 11.19.100 and the building-permit safety requirements in Chapter 10.40, the county Swimming Pool Safety Act. A pool cannot sit in the front or street-side yard inside the valley growth boundary, and its permit must address suction-outlet circulation and drowning-prevention hardware.
11.19.100. - Swimming pools and spas. Swimming pools and spas shall comply with Chapter 10.40, Swimming Pool Safety Act, of the County Code, as well as the following standards:(1)Within the valley growth boundary, swimming pools, spas or associated filtration equipment and pumps shall not be located in the front yard area or within the street side yard setbacks.(2)The outside wall of the water-containing portion of any swimming pool or spa shall be located at least five feet from all interior side and rear lot lines for above ground pools or spas and three feet for in ground pools or spas. 10.40.046. - Requirements to be met by pool or spa upon issuance of a building permit. Full Breakdown
Section 11.19.100 folds pool siting into the general zoning code: swimming pools, spas, and their filtration equipment and pumps are barred from the front yard and street side yard setback areas within the valley growth boundary, and the water-containing shell of any pool or spa must sit at least five feet from interior side and rear lot lines if above ground, or three feet if in ground. That same section directs applicants to Chapter 10.40 for the rest of the permit package. Chapter 10.40 defines a swimming pool as any structure for swimming or recreational bathing holding water over 18 inches deep, including in-ground and above-ground pools, hot tubs, spas, and nonportable wading pools, under Section 10.40.030.
Whenever a building permit is issued for a new pool or spa, Section 10.40.046 requires the suction outlet to provide circulation as prescribed in the chapter, with at least two circulation drains per pump, hydraulically balanced and separated by at least three feet, and any suction outlet under 12 inches across covered with an antientrapment grate meeting ASME/ANSI Standard A 112.19.8. Remodeling or modifying an existing pool suction outlet triggers the same antientrapment upgrade under Section 10.40.047. Separately, since January 1, 2007, new residential pools must carry at least one drowning-prevention feature, such as an approved enclosure, mesh fencing, a safety pool cover, exit alarms, self-latching doors, or a pool alarm, under Section 10.40.035.
Anyone contracting to build a pool must notify the buyer of these requirements under Section 10.40.045. Public pools, spas with ASTM-compliant locking covers, apartment complexes, and pools in cities with equally strict ordinances are exempt under Section 10.40.050.
Violations & Fines
Before signing off on a completed or remodeled pool, the Building Official inspects the required drowning-prevention safety devices under Section 10.40.035(c) and withholds final approval if any are missing. Installing a pool without the Chapter 10.40 antientrapment drain covers or the required safety enclosure, or building it inside the barred front or street-side setback under Section 11.19.100, leaves the project without final building-permit sign-off until the deficiency is corrected.
