Pismo Beach, CA Swimming Pools & Spas: Pool Permits (2026)

Pismo Beach adopts the 2025 California Building Code and California Residential Code in § 15.04.010 and amends the permit exemption list in each. Pools appear on both lists, and the limits differ. The Building Code exemption in § 15.08.010, Section 105.2, item 9, covers prefabricated swimming pools accessory to a Group R-3 occupancy that are less than 24 inches (610 mm) deep, not greater than 5,000 gallons (18 925 L) and installed entirely above ground. The Residential Code exemption in § 15.08.020, Section R105.2, item 7, covers prefabricated swimming pools that are less than 24 inches (610 mm) deep. A pool that is not prefabricated, or that is 24 inches deep or more, falls outside both lists. In the sections read for this page, the exemption is the only pool-specific permit language.

Both sections open with the same warning: exemptions from permit requirements do not grant authorization for work done in violation of the code or any other law or ordinance of the jurisdiction.

The general permit mechanics apply to a pool project. Plan review fees are paid when submittal documents are filed, follow the schedule set by the governing body, and are separate from permit fees (Section 109.2.1). An application is deemed abandoned 365 days after filing unless a permit has been issued, with extensions of not more than 90 days each (Section 105.3.2). Starting work without a required permit means a special investigation and an investigation fee equal to the permit fee (Section 109.4).

Pool water is regulated too. Emptying and refilling swimming pools and commercial spas is prohibited at the severely restricted water supply level except to prevent structural damage or to provide for the public health and safety (§ 13.24.050 H). The Stormwater Quality Ordinance defines an illicit connection to include a conveyance that allows an illegal discharge, including pool or spa water, to enter the storm drain system (§ 13.28.030).
