Taunton, MA Swimming Pools & Spas: Pool Permits (2026)

Section 250-1 of the Taunton Code bars anyone from undertaking work covered by Sections 250-2 through 250-6, including pool construction, without first applying for and obtaining the required permits, and Section 250-3's fee schedule sets the electrical inspection and permit fee for a residential swimming pool at $52 for an aboveground pool and $78 for an in-ground pool. Separately, Chapter 387, Section 387-1 requires any artificial pool at least 24 inches deep, whether or not it existed before the ordinance, to be enclosed by a protective fence at least four feet high, or another approved barrier, with design, materials and construction approved by the Superintendent of Public Buildings.

Every gate in that fence or barrier must be self-closing and self-latching, with the latch mounted at least 54 inches above the ground, and all fencing must also comply with the Massachusetts State Building Code; public and semi-public pools must additionally meet Board of Health requirements. On the zoning side, Section 440-708 allows both in-ground and aboveground pools by right, but requires any pool holding 500 gallons or more to sit at least 10 feet from any side or rear lot line. Work performed on a pool without first getting the permit is billed at triple the ordinary fee under Section 250-2, matching the general no-permit penalty in Section 250-7.
